Bill C-45: Why YOU Should Give a Damn

Idle No More Protest - Jan 4 2013

On December 14th, 2012 Senate passed Bill C-45 in the House of Commons. Once this bill is signed by the Governor General it becomes law.

First Nations are refusing to honour the bill. The bill is a clear violation of over one hundred years of commitments made by the federal government. Indigenous people are disgusted by Bill C-45. The federal government’s favour of the bill is a blatant middle finger to First Nations communities who were not, as per treaty and indigenous agreement, consulted before instituting the legislation.

But why should the average Canadian citizen give a damn?

Bill C-45 weakens environmental protection and Indian reserve land rights. Among the omnibus amendments are changes to the Fisheries Act, the Navigable Waters Protections Act and the Indian Act. Essentially, the bill rewrites environmental laws that promoted and protected clean waterways and a sustainable ecosystem.

As quoted in the Canadian University Press, “The 130-year-old Navigable Waters Protection Act will be changed to the Navigation Protection Act, which will see thousands of Canadian lakes and rivers removed from federal protection. The government argues that the new act makes it easier to begin necessary infrastructure projects along waterways but Idle No More supporters believe the amendment too highly prioritizes industrial development over the environment."

"C-45 critics also argue that changes to the Fisheries Act, which previously required companies to build new lakes or streams when one of their projects damaged waterways, will allow companies to opt out of these environmental commitments. They also argue that changes in the Environmental Assessment Act will too significantly relax the environmental review process.”

Barbara Day was stamping her frozen toes at Friday’s Idle No More protest in front of Sault Ste. Marie’s courthouse. “Bill C-45 takes away our Canadian rights to say how our resources are used. Basically, it gives the government, mines and big corporations more power. They can do what they like and the people have to suffer the effects to the environment and loss of resources. Canadians need to worry about this.”

Idle No More Protest - Jan 4 2013

Canada is estimated to boast 32,000 major lakes and 2.5 million rivers. Once this bill is signed and made law only three oceans, 97 lakes and portions of 62 rivers will remain protected. Under the new bill, pipelines will be exempt which means it will no longer be necessary to conduct environmental impact studies to determine their effect on the waterways and the well-being of people affected by these waterways.

Devon Page, executive director of Ecojustice states, “Simply put, lakes, rivers and streams often stand in the path of large industrial development, particularly pipelines. This bill hands oil, gas and other natural resource extraction industries a free pass to degrade Canada’s rich natural legacy."

"With this bill, the federal government’s position is very clear: building pipeline projects like Northern Gateway and making way for increased tanker traffic is more important than safeguarding Canada’s rivers, lakes, streams and oceans. If you fish or play in our waters, or care what goes in your water glass, you should be alarmed.”

Batchewana Chief, Dean Sayers, shares these concerns. “Water is going to become a commodity. We’ll probably have to start drinking bottled water”

Chief Sayers is equally concerned about modifications to the Indian Act.

Idle No More Protest - Jan 4 2013

“Right now Canada is trying to help First Nations who have a different perspective about our relationship to the land and to be able to sell their land. That’s really contrary to our original communal expectations of how we look after the land. The government is leaving it open to the discretion of any First Nations. Indian Affairs will help them broker a deal and we’ll have less land. It is a detriment to us. We need to have a land base. We need to have a place for our unique culture, our language and our spirituality. Our communities need to have a place to live."

"I think when you add it all up it is a real slight on our nationhood. With Harper’s imposition of legislation and how we conduct ourselves, it takes away from our autonomy as a Nation. We are a unique culture, a unique nation and we exercise our nationhood around the world. Harper cannot extinguish our nationhood.”

Chief Sayers' concerns encompass all of Canada and certainly the globe. A leader for his Anishinabek community, he has also consistently demonstrated a broad concern for all people.

“I pray as a result of this action that’s happening all around the world that we’ll create a better place for everyone to live. And that it will be based on our original understanding of how we would all live together. I believe that is what needs to happen.”

Protesters shut down Highway 403 for a second round of Idle No More protests in Hamilton Saturday afternoon.

Drivers, ironically, sat idle on the westbound 403 as a group of about 250 people marched down the King Street West on-ramp with drums and signs challenging Stephen Harper and Bill C-45.
“Sometimes you have to make a little bit of noise in order to be heard,” said protester Kathleen Quinn, a 24-year-old Hamilton woman who said she was marching in solidarity with Indigenous peoples.
Groups across Canada marched simultaneously Saturday as part of a national grassroots movement against Bill C-45, legislation which First Nations groups say threatens reserve lands and the number of federally protected bodies of water.
It’s an issue that affects everyone, said organizer Myka Burning.
“The bill we’re fighting against directly affects our water, our air, our land…it’s not only aboriginal people that drink water…this affects all of us,” she said.
Deganadus McLester agreed. At the front of the pack, he and friend Gasenneeyoh Crawford held up one end of the Idle No More sign, spanning almost the entire three lanes of the highway.
Stopping traffic with a public march “helps permeate some of the invisible walls that people say separates them from the movement,” he said.
With traffic stopped for about a half hour, passersby had no choice but to pay attention. And many did—one car in fact rear-ended another as traffic slowed in the opposing eastbound lanes to watch the march.
Even as they headed down the ramp from the overpass above, the group received supportive “honks” from passing traffic.
“It’s not about us or them,” McLester said. “The barriers are starting to crumble.”
Many of the same protesters took part in a rally at City Hall on Dec. 22. At that event, the group called on Prime Minister Stephen Harper to meet with Theresa Spence, the chief of northern Ontario’s troubled Attawapiskat First Nation, who has been on a hunger strike since Dec. 11.
Though Harper has since agreed to meet with Spence, Burning said that is not enough. The meeting was scheduled as a follow-up to a sit-down last year, she said.
“He hasn’t actually done anything.
I think he (Harper) hoped that everything would just sort of peter out,” she said. Her group has no intention of slowing.
“I think he (Harper) has realized it’s been stepped up a notch,” Burning said.
“Holding public rallies is one thing, but blocking a highway – people take notice.”
The cause, which began last month, is in protest of the federal government’s omnibus Bill C-45, which First Nations groups claim eliminates treaty rights set out in the Constitution.
Waving flags and carrying placards, many of the demonstrators marched along roadways, highways and bridges prompting police to report several delays and closures.
Police in Cornwall, Ont., closed the Seaway International Bridge early Saturday as a public safety precaution.
It’s unclear when the usually-busy toll bridge, which connects the southeastern Ontario city and Akwesasne, Ont., to Massena, N.Y., will be re-opened.
Cornwall Sgt. Marc Bissonnette says there are about 100 to 150 demonstrators marching on the bridge.
Police are continuing to monitor the protest, which has been peaceful. No incidents have been reported.
The border crossing between Sarnia, Ont., and Port Huron, Mich., was also temporarily shut down for a few hours Saturday to an Idle No More protest there. It has since re-opened.

Beloved Ones,

The year end festivities are completed and the New Year has arrived with such a stupendous display of Unity in the form of a major Worldwide meditation with ten of thousands of Lightworkers such as yourselves all over your Planet saying yes to the remembrance and the embodiment of their Divinity. From our perspective, the tide has turned and the people of the World will be seeing many changes taking place, both within themselves, their loved ones, their neighbors and within the structures of daily life that have been in place for so long. We from the Higher realms were in attendance during this massive observance on the first day of your New Year and there were Legions of Angels assisting in the activations that occurred.

Each person who took part is a Wayshower and a Pattern Maker who realized the great potential of this major event to create positive change for Humanity and all upon the Earth and there will be many more of these taking place through the entire year of 2011, for this is the year of the unification of forces for good upon this Planet in a big way. What a wondrous boost to the Divine Plan this event was! We are still in celebration! Each of you is so powerful and so courageous in your determination to be the change you wish to see. The peaceful revolution we spoke of before is now upon us and we applaud you all! Your combined and individual energies have made a remarkable difference upon your Planet and this will become observable in your daily lives.

Continue to walk your Path of Light, Dear Ones, and hold fast to your visions for the highest outcome for the Ascension of the Planet Earth and all upon Her, for it is happening in this time of Now. Continue in your purifying efforts for your bodies, minds and emotions. Know that what comes forth and is cleansed and transmuted is creating room within you for greater Light to take its place and every time this occurs, it is another step forward upon your spiritual journey to Ascension. Remember that we stand ready to assist you in every moment of your life and all that is required is that you ask us, for we must honor your free will.
